Erie county is located in the US State of New York. The county gets its name from Lake Erie which in turn is named after a tribe of Indians who lived to the South and East of the lake before 1654. The county is a part of Buffalo- Niagra Falls Metropolitan Statistical area. The county seat is Buffalo.

Divorce records are available through the county clerk’s office; however divorce records are available only to the plaintiff, defendant or attornies of the record. If you were not one of the parties involved in the divorce you will be able to review the file only after you have obtained a notarized statement from either of the litigants or with a court order.

Requests for searching can be made in writing to Erie County Clerk’s Office, 25 Delaware Avenue, Buffalo, New York- 14202. A check of appropriate amount should be forwarded along with the search request. Payment can be made at the time of picking up the documents from the county clerk’s office. The processing time is at least 3 business days.

The office of the county clerk is open from Monday to Friday between 9 am to 5pm. The request forms for records are accepted till 4:45 pm.

The New York State Health Department can also be contacted to procure divorce records. A fee of $30 is charged for every divorce copy certificate with an additional $15 for priority handling. You can place an order for a copy of divorce certificate over the telephone or Internet and make payment using a major credit card. This method will require you to pay an additional $7.25 as vendor processing fee per transaction. The processing time is 5 to 7 business days. An overnight delivery will cost you an additional $12.

You can also send mail requests with a check or money order payable to New York State Department of Health.The usual processing time is 2 to 3 weeks from the day of the receipt. Applications submitted without proper identification will result in rejection of your application.
